Gemini American Spirits LLC ("Gemini," "we," "us," or "our"), located at 251 N Cass Ave, Unit D, Westmont, IL 60559, operates geminispirits.com (the "Site"). This Privacy Policy explains what personal information we collect when you visit our Site or contact us, how we use and protect that information, and the choices you have.

By using this Site, you agree to the practices described in this Policy. If you do not agree, please discontinue use of the Site.

In plain terms: We collect only what we need to respond to business inquiries and improve the Site. We do not sell your personal information to third parties.
02

Information We Collect

We collect information in two ways: directly from you, and automatically through your use of the Site.

Information you provide directly:

  • Contact and inquiry data — your name, email address, company name, phone number, market region, and inquiry type when you submit our contact form.
  • Communications — the content of any emails or messages you send to us.

Information collected automatically:

  • Usage data — pages visited, time spent on pages, referring URLs, and click paths.
  • Device and browser data — IP address, browser type and version, operating system, and device identifiers.
  • Cookie data — see Section 5 for full details.

We do not knowingly collect sensitive personal information such as government ID numbers, financial account details, or health data through this Site.

03

How We Use Your Information

We use the information we collect for the following purposes:

  • To respond to your business inquiries and facilitate trade discussions regarding bulk spirits sourcing, distribution partnerships, or general questions.
  • To send follow-up correspondence related to your inquiry, including quotes, logistics information, or partnership materials.
  • To improve the Site's content, navigation, and user experience.
  • To comply with applicable legal obligations, including alcohol trade regulations in the jurisdictions where we operate (USA, UK, Canada, EU, Oman, UAE, and GCC regions).
  • To detect, prevent, and address technical issues or fraudulent activity.

We do not use your information for automated decision-making or profiling that produces legal or similarly significant effects.

04

Sharing & Disclosure

We do not sell or rent your personal information. We may share it in the following limited circumstances:

  • Service providers — trusted vendors who assist us in operating the Site (hosting, email delivery, analytics). These parties are contractually bound to use your data only as directed by us.
  • Business partners — where you have explicitly inquired about a distribution partnership, we may share relevant details with our regional import/export partners to facilitate your request.
  • Legal compliance — when required by applicable law, court order, or regulatory authority, including alcohol licensing and trade compliance bodies in the jurisdictions where we operate.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, in which case we will notify you before your information is transferred and becomes subject to a different privacy policy.
05

Cookies & Tracking

Our Site uses cookies and similar technologies to function properly and to understand how visitors use it. The categories of cookies we use include:

  • Strictly necessary cookies — required for the Site to operate (e.g., security tokens, session management). These cannot be disabled.
  • Analytics cookies — help us understand aggregate traffic patterns and popular content. Data is pseudonymized where possible.
  • Plugin cookies — set by embedded functionality such as our contact form and the Slider Revolution plugin.

You can manage or disable non-essential cookies through your browser settings. Note that disabling cookies may affect the functionality of certain features on the Site.

06

Age Verification

Gemini American Spirits is a business-to-business spirits company. Our Site is intended solely for use by adults of legal drinking age in their jurisdiction and by industry professionals engaged in lawful spirits trade.

We do not knowingly collect personal information from individuals under 21 years of age (or the applicable legal drinking age in your region). If you believe we have inadvertently collected data from a minor, please contact us immediately at ceo@geminispirits.com and we will take prompt steps to delete it.

07

International Transfers

Gemini American Spirits operates globally, with trade relationships spanning India, the USA, UK, Canada, the European Union, Oman, the UAE, and wider GCC countries. Your personal information may be transferred to and processed in countries outside your own, including the United States, where our primary operations are based.

When transferring personal data internationally, we apply appropriate safeguards consistent with applicable law — including, where required, Standard Contractual Clauses under GDPR or equivalent mechanisms. By submitting information through our Site, you acknowledge and consent to this international transfer.

08

Data Retention

We retain personal information for as long as necessary to fulfill the purpose for which it was collected — typically the duration of our business relationship with you, plus any additional period required by applicable law or regulation.

Inquiry data from our contact form is generally retained for up to 3 years from the date of last correspondence. Analytics data is retained in pseudonymized form for up to 26 months. After these periods, data is securely deleted or anonymized.

09

Your Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Access — request a copy of the personal data we hold about you.
  • Correction — ask us to correct inaccurate or incomplete data.
  • Deletion — request erasure of your personal data, subject to legal retention obligations.
  • Restriction — ask us to limit processing of your data in certain circumstances.
  • Portability — receive your data in a structured, machine-readable format (where applicable under GDPR or similar law).
  • Objection — object to processing based on legitimate interests.
  • Withdrawal of consent — where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing.

Residents of California (CCPA/CPRA), the European Union/EEA (GDPR), the UK (UK GDPR), Canada (PIPEDA), and other applicable jurisdictions may have additional rights. To exercise any of these rights, contact us using the details in Section 12. We will respond within the timeframe required by applicable law (typically 30 days).

10

Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These include encrypted data transmission (HTTPS), access controls, and secure hosting infrastructure.

No method of transmission over the internet is completely secure. While we strive to protect your information, we cannot guarantee its absolute security. In the event of a data breach affecting your rights and freedoms, we will notify you and relevant authorities as required by law.

11

Policy Changes

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will update the "Last updated" date at the top of this page.

We encourage you to review this Policy periodically. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Policy.
